EU GREEN DEAL COMPATABILITY STUDIES

With the European Green Deal in DECEMBER 2019, European Union (EU) announced aims to be the first CARBON NEUTRAL continent by 2050.

In 2050, the European Green Deal demands that the countries that trade with it,- reduce their greenhouse gas emissions within a set program to make the EU climate-neutral.

The EU Commission also published the Fit For 55 package on 14 July 2021. Fit for 55 refers to the EU’s target of reducing net greenhouse gas emissions by at least 55% by 2030 compared to 1990 levels. The proposed package aims to bring EU legislation in line with the 2030 goal.

According to the sixth assessment IPCC report, the increase in extreme atmospheric events seen globally in recent years is a result of the warming of 1.1 degrees so far! If new precautions are not taken, it will rise above 1.5 degrees or even 2 degrees in 20 years.

It is aimed to implement the Carbon Border Adjustment Regulation Mechanism in order to protect the competitiveness of Europe and to prevent the shift of production and investments to countries with less emission reduction targets than the EU, in the face of the cost to be incurred by the policies targeted with the European Green Deal on the European industry.



IN OUR COUNTRY, THE GREEN RECONCILIATION ACTION PLAN WAS PUBLISHED IN JULY 2021, UNDER THE COORDINARY OF THE MINISTRY OF TRADE. THE ACTION PLAN CONTAINS 81 ACTIONS UNDER 9 MAIN HEADLINES TO FIND THE GREEN RECONCILIATION TARGETS.

CARBON BORDER ADJUSTMENT MECHANISM (CBAM)

It is recommended by the Commission to start the implementation with a 3-year transition period as of 1 January 2023, which does not impose any financial obligations. With the published draft: the design of the CBA mechanism, its sectoral scope, application procedures and principles are explained.

·         According to the statement made by the Council on 15 March 2022, Carbon Border Adjustment Mechanism (CBAM) will be applied for the first time on the imports of cement, aluminum, fertilizer, electric power generation, iron and steel products as of January 1, 2023.

·         According to the report to be submitted by the Council to the European Parliament and the Council of Europe until 1 January 2026, the scope of the product groups to which the regulation will be applied can be expanded.

·         With the decision of the EU Commission, the application of the rules applied to the producers within the EU borders to the imported goods and the prevention of carbon leakage will be implemented on 1 January 2026.

·         Covers all countries that do not have an application like ETS.

·         Iron and Steel, Aluminum, Cement, Fertilizer and Energy sectors were included in the priority sectors in the first phase with the decision of the EU Commission on 14 July 2021.

·         For 3 years between 01 January 2023 and 01 January 2026, only the tax that be notified will not be paid.

·         It is the responsibility of the IMPORTER companies to submit the notification.

·         Importers are obliged to DECLARE the goods they import and the carbon amount quarterly/ annually.

·         The declaration will be made on direct and indirect emissions.

·         In 2026, they will apply for Carbon Allocation.

·         The Carbon Quota/Tax to be obtained by the importer companies through allocation will be determined by the EU ETS daily price.

·         In the annex of the EU directive containing Carbon Border Tax Mechanism, published on 14.07.2021 within the scope of the European Union Green Deal, companies exporting goods belonging to the 5 priority sectors with Customs Tariff Statistics Position (GTIP) number will make a notification between 2023 and 2026 and will be subject to taxation processes as of 2026.

ANNEX I List of goods and greenhouse gases

1.      For the purpose of the identification of goods, this Regulation shall apply to goods listed in the following sectors currently falling under the combined nomenclature (‘CN’) codes listed below, and shall be those of Council Regulation (EEC) No 2658/87 ( 1 ).

2.      For the purposes of this Regulation, the greenhouse gases relating to goods falling in the sectors listed below, shall be those listed below for each type of goods.
